Organizations and the entities of a penal correction system can't participate in purchases under the Law N 44-FL among the small business entities (SBE) and the socially oriented non-profit organizations (SONPO) as they aren't them.
As the order of participation of a group of persons in the purchases which are carried out under the Law N 223-FL legislatively isn't regulated, the Ministry of Economic Development considers that the customer should establish this order in documentation on purchase. We believe, it needs to be reflected also in regulations on purchase.

The Ministry of Economic Development notes: the regulations regulating an order of placement of scheduled plans don't require to bring in the schedule for 2016 an identification code of purchase which is carried out under the Law N 44-FL.

The line item of the Ministry of Economic Development is proved by the following. The customer establishes rules of purchases under the Law N 223-FL in regulations on purchase. Carrying out purchases, it shall be guided including the Civil Code of the Russian Federation. The code doesn't prohibit to sign agreements on a compensation.
On August 2, 2016 the State committee of RT on purchases, with organizational support SUE RT "Centre razvitiya zakupok RT", held a free seminar for the customers working under the Federal law of 18.07.2011 No. 223-FL "About purchases of goods, works, services as separate types of legal entities".
67 representatives of 40 organizations of the Republic of Tatarstan working under the specified law participated in a seminar.
On September 18, 2016, in single ballot day, State Duma elections of the Russian Federation of the seventh convocation will take place. Elections will take place according to the new legislative arrangements established by the federal laws "About Elections of Deputies of the State Duma of the Federal Assembly of the Russian Federation" of February 22, 2014, "About basic guarantees of the electoral rights and the participation rights in a referendum of citizens of the Russian Federation" of June 12, 2002 and also other regulatory legal acts.
In the list of cases when under the Law N 44-FL purchase at the unique supplier is possible, it is offered to include purchase at organizations of persons with disabilities of those goods, works, services which are entered in the list approved by the government.
The prohibition is established in the draft of amendments to the Law N 44-FL. This requirement is applicable when the supplier, the contractor, the contractor undertakes to involve the small business entity (SBE) or the socially oriented non-profit organization (SONPO) in performance of the contract.
