When purchasing on 223-FL customer has the right to specify the estimated price of the agreement in documentation

The Ministry of Economic Development has come to such conclusion in "letter". Department expressed "Similar opinion" in October, 2015. As we see, since then the position on this question hasn't exchanged.

In practice there can be situations when in case of purchase execution the customer can't determine necessary quantity of the purchased goods, works or services. Then department "recommends" to use one of the following options:

- in documentation and the notice on purchase to establish the starting (maximum) price of each goods, work or service and the total starting (maximum) price of the agreement;

- to specify estimated price in the same documents.

We believe, the customer should fix an opportunity to use such options in regulations on purchase. Besides, it is possible to establish cases in which the customer has the right to realize it, for example, purchase of spare parts. It will allow to order purchasing process and to simplify it.
