Photos of stages of contract performance can oblige to apply state customers to the report on its execution

"Project" with such amendments to the Law N 44-FL is under consideration of the State Duma. Now customers have no obligation to apply to the report of the photo of stages of performance of the contract.

On the project results of photofixing of stages of performance of the contract will need to be put to the report if the subject of the contract is the construction, overhaul, reconstruction of an object of capital construction. It will be necessary to put photos to the performance report of the contract in general. Also, if the contract provides separate stages of its execution, the photo will need to be put also to the report on results of a separate stage.

It is possible to assume: if the project becomes the law, for accomplishment of an obligation customers should include a new condition in contracts. It will shall provide an obligation of the contractor of the contract to make photofixing of stages of its execution and transfer of pictures to the customer.

Now the customer attaches the following documents to the report:

- the expert opinion if the customer involved experts, the expert organizations;

- the document on acceptance of results of execution or other, the document determined by the legislation of the Russian Federation.

According to authors of the project, the planned changes will allow to reveal defects at early stages when constructing facilities for the state and municipal needs. Besides, the customer will have an opportunity to eliminate such defects.

We believe, for non-stationing in EIS of photos of stages of performance of the contract as annexes to the report "penalty" will threaten. For example, for officials of the customer the penalty will constitute 50 thousand rubles.
