The EXPERT of Ural federal district hasn't counted insufficiency of the budgetary financing as essential change of circumstances which the parties couldn't expect reasonably. The state customer has no right to refuse unilaterally performance of the contract in that case.

The electronic auction or different way of purchase under the Federal law "About Contract System in the Sphere of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" from 4/5/2013 No. 44-FZ will be suitable for such purchases.

According to court, we will allow such approach and doesn't prevent the customer to check characteristics of goods for compliance to the legislation. The indication of several countries doesn't mean that data on the country of origin aren't reflected.

On the project will be able to concede to the third party own monetary requirement to the customer those who properly fulfill the obligations.

The register will help to understand what legal entities have been fined for illegal remuneration and don't conform to the requirement of documentation. Such organizations can't be allowed to purchase.

When purchasing design and exploration work, and also works on construction, reconstruction and overhaul the participant of state procurement will have to confirm membership in self-regulatory organization. Admissions of SRO won't work.

We will designate important provisions of the bill:
- providing the contract can be reduced if the contractor of the customer has no unpaid penalties and not returned advance payment. It is also necessary that the customer has entered in the register of contracts of the data on cost of the fulfilled obligations;

According to department, in the contract there shouldn't be conditions about emergence at the customer of the rights for the site transferred with the building. An exception - the rights for the site under the uninhabited building, necessary for his use.

The state committee of RT on purchases with organizational support SUE RT "Centre razvitiya zakupok RT" has held on June 27 a seminar meeting for republican customers on a subject: "Features of implementation of purchases according to the Federal law from 4/5/2013 No. 44-FZ "About contract system in the sphere of purchases of goods, works, services for ensuring the state and municipal needs" in 2017".

If subject to purchase - the licensed kind of activity, the state customer is obliged to specify in the notice on request for quotation that the participant has to have a license.
