According to department, in the contract there shouldn't be conditions about emergence at the customer of the rights for the site transferred with the building. An exception - the rights for the site under the uninhabited building, necessary for his use.
If by the contract it isn't defined what right for the site is transferred, then it is considered transferred the right of use. His term is equal to rent term, notes the ministry, being guided by provisions of the Civil Code of the Russian Federation.
