Follows from explanations of antimonopoly service:
The Ministry of Economic Development considers: the customer has the right to demand in documentation that concerning the participant there were no judgments which have come into force. It is about decisions on application of sanctions for violation of contractual obligations.
Amendments have come into force on June 7. Under the Law N 223-FZ the unitary enterprises - drugstores will be able to carry out the purchases financed not from the budget.
The updated standard contract needs to be applied after 30 calendar days after it is placed in the Unified information system. So far such contract isn't placed.
According to the Ministry of Economic Development, the customer has the right to establish independently in the provision on purchase an order of purchase of drugs. Here department carries also the indication of trade names.
Department has specified: the scheduled plan of the attached establishment can't be applied. Due to the reorganization again created customer forms the scheduled plan and enters in him data on the forthcoming purchases.
Cancellation has technical character as the ban to buy from the Turkish companies of work and service for state needs has ceased to work since May 31. Thus, the government has brought the acts into accord with the Decree of the Russian President N 244.
Department has specified: The law N 44-FZ doesn't provide such opportunity. The participant or the person authorized by him have to sign the stitched and numbered application for participation in an open competition. Also it should be sealed the participant (in the presence of that).
Conclusion of the Ministry of Economic Development concerns electronic auctions on purchase of construction works if NMTsK is higher than 10 million rubles. At such purchases the customer has to establish the additional requirement about experience, and participants - to support by the documents that correspond to him.
The Ministry of Finance suggests to bring this innovation in the Law N 44-FZ.
