The bill submitted to the State Duma plans to include the entrepreneur in the register of unscrupulous suppliers in case of unilateral refusal of the customer from the performance of the contract in connection with a material breach of its terms by the supplier.

On July 3, at the traditional seminar-meeting with the customers of the Republic of Tatarstan, the vice-chairman of the State Committee of the Republic of Tatarstan for procurement, I.G. Bagautdinov spoke about the changes in the 44-FZ, which came into force on July 1, 2018.

The Government of the Russian Federation has taken the initiative to establish a rule according to which the results of the examination conducted by an expert or an expert organization in the framework of the Federal Law No. 44-FZ of April 5, 2013 "On the contract system in the procurement of goods, works, services to ensure state and municipal needs ", are drawn up in the form of a conclusion, which is signed by an expert, an authorized representative of an expert organization. It is supposed that it should be objective, reasonable and comply with Russian legislation.

New clause 5.1 will be supplemented with the Rules for the provision of benefits to organizations of persons with disabilities when determining the supplier (contractor, performer) with respect to the contract price they offer. In accordance with this rule, it is not possible to include goods, works, services included in the List of goods, works, services that are given advantages to organizations of disabled persons and not included in this list in the subject of one contract (one lot) (Decree of the Government of the Russian Federation of 22 June 2018 No. 716).

The State Duma adopted in the second reading a draft law according to which all MUEs and SUEs will be able to purchase at their own expense under the Law N 223-FZ. It is expected that the changes will come into force already this year.

The applicant complained to the antimonopoly authority about the procurement documentation under Law No. 223-FZ. However, he did not apply for participation in the procurement and did not seek clarification of the provisions of the documentation. The FAS management recognized the complaint as unfounded. The applicant challenged this decision in court.
