The state customer can not demand that the participant indicate his INN in the quotation application

29 June 2018, Friday

In the form of a quotation application, the customer provided a field for the purchase participant's TIN. No application was rejected due to the lack of these data.

Nevertheless, the supervisory authority and the courts recognized such a requirement as a violation of Law No. 44-FZ. Asking the participant for quotations information and documents that are not provided for by Law No. 44-FZ is prohibited.

Taking into account the approach of FAS and courts, the customer should not be required from participants to include in the TIN application.
