The rules for the formation of the subject of the contract concluded with the organization of invalids

New clause 5.1 will be supplemented with the Rules for the provision of benefits to organizations of persons with disabilities when determining the supplier (contractor, performer) with respect to the contract price they offer. In accordance with this rule, it is not possible to include goods, works, services included in the List of goods, works, services that are given advantages to organizations of disabled persons and not included in this list in the subject of one contract (one lot) (Decree of the Government of the Russian Federation of 22 June 2018 No. 716).

The new rule will be applied from July 3.

Recall that when purchasing a customer is required to provide benefits, including organizations of people with disabilities (Article 29 Federal Law No. 44-FZ of April 5, 2013 "On the contract system in the procurement of goods, works, services to ensure state and municipal needs" ). They consist in granting these organizations an advantage in respect of the proposed contract price of up to 15% in accordance with the procedure established by the Government of the Russian Federation.
