The Ministry of Finance has proposed new rules for mandatory public discussion of purchases. The current government resolution of 22.08.2016 № 835 plan to cancel. If the draft is adopted, the new rules will come into force on October 1, 2019.
 

In particular, the letter prepared by the specialists of the Ministry notes that the term of the Bank guarantee provided by the counterparty to ensure the guarantee obligations must exceed the term of performance of the guarantee obligations stipulated by the contract for at least one month. In this case, the period of return to the counterparty of funds deposited as collateral for warranty obligations shall not exceed 30 days from the date of performance of warranty obligations. And in case of establishment by the customer of the restriction provided by part 3 of Art. 30 of the Federal law of April 5, 2013  No. 44-FZ "on contract system in the sphere of procurement of goods, works, services for state and municipal needs" (hereinafter – Law No. 44-FZ), such period shall not exceed 15 days from the date of performance of warranty obligations provided for in the contract.

In particular, in prepared by experts of Department letter notes that article 18.1 of the Federal law of 26 July 2006 No. 135-FZ "On protection of competition" (hereinafter – the Law № 135-FZ) has established an independent grievance procedure for violation of the bidding procedure, procedure for conclusion of contracts that is not related to the procedure of consideration of cases on violation of antitrust legislation and, accordingly, the provisions of part 2 of article 52 of the Law No. 135-FZ shall not apply to cases of extradition to the antitrust authority of these regulations. Thus, this procedure does not provide for the possibility of suspending the execution of the relevant order on the basis of consideration of the complaint in case of appeal in court.

If the customer has not paid for the goods, works or services in a timely manner, the contractor has the right to charge a penalty for each day of delay. The amount of penalty is 1/300 of the key rate (previously-the refinancing rate).
 

The customer announced the purchase of works on the maintenance of roads. The work had to be carried out at 54 sites in 17 administrative districts. The Supervisory authority decided that the consolidation of the lot led to an unjustified restriction of participants. The customer had to divide the purchase into several lots and re-hold the auction.

The customer announced a competition with limited participation for catering services. In the documentation, he specified the requirements for the products that the participant must use in the provision of services. The participant complained to the Office of the FAS on the restriction of competition.

The customer refused to accept the goods due to discrepancies with the terms of reference for two parameters and demanded to deliver the goods of good quality. In response, the supplier referred to the manufacturer's information letters that the goods offered met the requirements of the contract. The customer refused to perform the contract and went to court to collect a fine.

The Agency wants to bring the standard contract for the supply of medicines for medical use in accordance with the current legislation on the contract system. Public discussion of the project ends on October 1.
