Court: in the notice of public procurement, you can specify information in the form of a reference to documentation
The customer specified in the notice, the deadlines, the procedure for paying money in support of the application, the order granting enforcement of the contract requirements, the Bank contract, making reference to the phrase "in accordance with the documentation".
The control body considered this a violation. If there were not enough characters for the information, you had to attach a file with the necessary information.
However, the courts decided otherwise. Documentation is placed in the EIS at the same time as the purchase notification, so reference phrases in the notification do not violate the principles of completeness and reliability of information. Potential participants could read it in the competition documentation. The law N 44-FZ does not prohibit the use of phrases referring to documentation in the notification.
Note that the practice on this issue is ambiguous. Previously, courts and antitrust authorities came to this conclusion: you can make a reference to the documentation in the notification, but you need to specify specific points in the documentation. To avoid possible disputes, we recommend taking this position into account when preparing a purchase.
