The public procurement participant must indicate in the application for compatibility of the product with the customer's equipment
The customer made a purchase of liquid for inhalation. The vials had to be compatible with existing equipment. The participant offered the product, as well as an additional adapter for equipment. His application was rejected for inconsistency of information. The participant considered this illegal and complained to the Antimonopoly authority.
Controllers supported the customer:
- the application did not indicate that the offered product is compatible with the customer's equipment;
- the adapter was not provided under the terms of purchase and was intended for equipment that differs from the one specified in the documentation;
- the customer explained the requirement for compatibility of the product with the equipment.
The complaint was found unfounded.
