Representatives of department explained that for implementation of purchases according to the Law N 223-FL the budgetary institution created as a result of reorganization in the form of transformation needs to approve regulations on purchase. At the same time in case of statement and placement of a regulations on purchase in EIS in 2016 the budgetary institution will be able to conduct procurement according to the provisions of the law N 223-FL not earlier than 2017. Up to this point the budgetary institution needs to conduct procurement according to provisions of the Law N 44-FL.

Owing to item 4 p.1 of Art. 32 of the Law N 44-FL, and also Rules of assessment of requests, final offers of procurement participants of goods, works, services for ensuring the state and municipal needs approved by the order of the Government of the Russian Federation of 28.11.2013 N 1085 for assessment of requests, final offers the customer in documentation on purchase establishes among others such criterion as qualification of procurement participants, including availability at them of the work experience connected with the subject of the contract and business reputation, specialists and other workers of a certain skill level.

The order of interaction of Federal Treasury with the subjects of control specified in points 3 and 6 of Rules of the control provided by part 5 of article 99 of the Federal law "About Contractual System in the Sphere of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" will come into force on January 1, 2017 and is approved according to item 12 of the Rules approved by the order of the Government of the Russian Federation of 12.12.2015 N 1367 according to the p. 6 of Art. 99 of the Law N 44-FL which will also come into force since January 1, 2017.

Corresponding changes are made to subitem "а" item 3 and item 13 of Rules of change by agreement of the parties of a contract date, and (or) the contract prices, and (or) the price of a commodity unit, work, service, and (or) goods quantity, amount of works, the services provided by contracts which completion date comes to the end in 2016, approved by the order of the Government of the Russian Federation of 14.03.2016 N 191.

Changes come into force on October 15, 2016.

As pointed out by experts of department, if the activity which is the object of the purchase is subject to compulsory licensing, the customer, guided by the provisions of Law N 44-FL, I am obliged to establish a party to the purchase requirement to submit with your application a copy of the license to perform these activities.

Changes will take effect on 30 August and touched pp 7, 8 of the Procedure approved by Order of the Federal Treasury from 11.28.2014 N 18H and Annex N 1 and N 2 to him.

On January 1, 2017 will come into force Art. 20 of Law N 44-FL, because of h. 1 that the cases of mandatory public discussion of procurement and the procedure established by the Government. Thus, in accordance with Part. 4 Art. 20 of Law N 44-FL of purchases that require public discussion, can not be implemented without conducting such a discussion.

According to Art. 14 of the Law N 44-FL the List of separate types of the foodstuff coming from foreign states concerning which restrictions of the admission for the purposes of implementation of purchases for ensuring the state and municipal needs are set is approved.

The state committee of RT on purchases with organizational support SUE RT "Centre razvitiya zakupok RT" held on September 27 a seminar meeting for SMP, SSP, SONKO, organizations of persons with disabilities and republican producers on a subject: "Participation in procurement according to 44-FL and 223-FL".

According to representatives of department, by results of running an electronic auction the customer perfroms calculation of unit price of goods (work, service) which he includes in the draft contract placed by it in EIS according to the p. 2 of Art. 70 of the Law N 44-FL.
