If the made goods don't meet the requirements of the state customer, that has to refuse the contract

According to the Ministry of Economic Development, the provision of the law N 44-FZ about the customer's duty to refuse unilaterally the contract is applied not only to delivery.
Department considers: this situation extends also to performance of work during which the goods provided by the contract are made.
We will remind, under the Law N 44-FZ the customer is obliged to refuse unilaterally performance of the contract if the contractor, the delivered goods don't conform to requirements of the notice on purchase, documentation on her. Similarly the customer has to arrive if the contractor has submitted false information on the compliance or compliance of goods to the specified requirements that has allowed it to become the winner.
For acceptance of the results of performance of the contract which aren't corresponding to his conditions, the official of the customer can be fined. The penalty threatens in case the contractor of the customer hasn't eliminated such discrepancy, and it has led to an additional expenditure of budgetary funds or to reduction of quantity of the delivered goods, the volume of the performed works, the rendered services. The size of a penalty makes from 20 thousand to 50 thousand rubles.
