Approach of the Ministry of Economic Development is useful when determining the winner in a competition if several applications for participation with identical conditions of performance of the contract are submitted.
In this situation a winner by rules of the Law N 44-FZ is the participant whose application has arrived before others. If any of participants of a competition made changes to the application, then it, according to the ministry, is considered given when this participant has presented to the customer the last changes.
