Actions for connection of authorized persons of customers to a subsystem of purchasing management of the Electronic Budget system are stipulated in Item 2 sections I of the Temporary order of connection to a subsystem of purchasing management of the Electronic Budget system which is the enclosure of the Ministry of Finance of the Russian Federation of 17.06.2016 N 21-03-04/35490. In particular, customers are obliged to provide in body of Federal Treasury for the place of servicing of the request for connection to a subsystem of purchasing management of the Electronic Budget system for the form given in the enclosure of the Ministry of Finance of the Russian Federation.

Since November 25 will be reworded as follows a position 2 of the N 1 Annex to the resolution of the Government of the Russian Federation from 2/4/2015 N 99 and a position 5 of the N 2 Annex to this Resolution.

Change is possible if the partner of the customer was reorganized in the form of transformation, merge or accession. The legal successor of the reorganized legal person will be a new contractor under the agreement. The Ministry of Economic Development already expressed "such opinion", emphasizing that other cases of change of the partner are inadmissible.

The customer falling under operation of the Law N 223-FL shall approve regulations on purchase within three months from the date of registration as the legal person. When purchasing during this period, according to the Ministry of Economic Development, the customer has the right to apply the Civil Code of the Russian Federation.

The Ministry of Economic Development considers that it is admissible to include such requirement in regulations on purchase. The customer independently determines rules of carrying out purchases on 223-FL in this document.

It is impossible to unite project and installation and construction works in one purchase as it can limit the competition. A conclusion of the Ministry of Economic Development is based on the Marine life protection act of the competition. Besides, the specified works are presented at the different markets and on each of them there are potential participants.

Under the Law N 44-FL the customer needs to demand that participants had no debts on taxes, charges and other obligatory payments in the budget system of Russia. As explains to FAS, the rent isn't established by the legislation on taxes and fees, the basis for its payment - the agreement.

The state committee of RT on purchases with organizational support SUE RT "Centre razvitiya zakupok RT" will hold a seminar – a meeting for SMP, SSP, SONKO, organizations of persons with disabilities and republican producers on a subject: "Participation in procurement according to 44-FL and 223-FL".

Such term is allotted by the legislation on appeal of actions, failure to act of the customer. If the customer provides in regulations on purchase 223-FL less time for the conclusion of agreements, it will limit the right of participants to appeal.

When items are bought, works and services from the government list, organization of persons with disabilities receive preferences. But if the customer included in one lot organizations of persons with disabilities cannot provide such items and items which are not entering this list, then advantage.
