I have confirmed to Russian Armed Forces the right of the state customer to impose increased requirements to the term of the bank guarantee

The economic board of Russian Armed Forces has considered case of the appeal of the decision of antimonopoly authority. He has considered that the state customer has established the illegal requirement to the bank guarantee in documentation. She had to act not less than 60 days from expiration date of term of the contract.
Inferior courts have shared opinion of FAS. The Supreme Court hasn't supported their position and recognized illegal the decision of antimonopoly authority. Under the Law N 44-FZ the term of the bank guarantee providing the contract has to be more than his validity period not less than for a month. The legislator hasn't set the maximum limit of action of the bank guarantee.
