The customer refused to perform the contract: an out-of-court examination found shortcomings in the work performed. The contractor did not respond to the claims.
The winner of the purchase did not send the contract on time and did not provide security for its execution, because he incorrectly determined the last day of the deadline for this.
The bidder complained that the customer did not set a refund period in the contract to ensure warranty obligations.
The customer explained that this is not necessary. According to the Law N 44-FZ, it is necessary to specify only the term of repayment of the amount to ensure the performance of the contract. It will return the guarantee within a reasonable time after the expiration of the warranty period for the works.
Updated the list of customers who do not establish a ban on purchases of foreign goods in accordance with Resolution No. 616 The Government of the Russian Federation has amended sub-paragraphs " d "and" e " of paragraph 3 of the resolution of April 30, 2020. No. 616 "On establishing a ban on the admission of Industrial goods originating from foreign States for the purposes of procurement for state and municipal Needs, as well as Industrial goods originating from foreign States, works (Services) performed (rendered) by foreign persons for the purposes of Procurement for the Needs of national Defense and State Security" (hereinafter – Resolution No. 616) (Resolution of the Government of the Russian Federation of December 31, 2020 No. 2407).
They propose to establish a single procedure for monitoring purchases under the Laws N N 44-FZ and 223-FZ. It will replace the current rules for public procurement only.
For customers under the Law N 44-FZ, it is planned to establish from January 1, 2022 a warning or a fine for non-compliance with the minimum share of purchases of domestic goods. It is assumed that for officials the fine will be from 20 thousand to 50 thousand rubles.
Since the new year, the code 32.50.500.000 for OKPD2 is excluded from the classifier. It is in the list of foreign disposable medical products made of PVC with restricted access.
They propose to change paragraph 11 of Part 1 of Article 93 of Law No. 44-FZ. Production of goods (performance of works, rendering of services) from the special list will be extended to the internal system needs of the UIS (p. 3 of the project).
