It is proposed to envisage a procedure for increasing the price of contracts for the performance of works on the repair of federal highways
The draft of the corresponding decree of the Government of the Russian Federation was prepared by the Ministry of Transport of Russia. In particular, according to the document, it is proposed to provide for the following conditions, in the presence of which it will be possible to adjust the terms of these contracts in connection with a significant increase in prices for construction resources in 2021:
• changes in the essential terms of the contract are carried out within the limits of budgetary obligations brought to the attention of the recipient of the federal budget funds, and does not lead to an increase in the price by more than 30% and (or) the term of the contract;
• the scope of work stipulated by the project documentation, structural, organizational, technological and other solutions do not change;
• the amount of the increase in the contract price is determined in accordance with the procedure established by the relevant methodology;
• an additional agreement is concluded in writing on the basis of the contractor's proposal to change the essential terms of the contract, with the attachment of information and documents justifying such an offer;
• the contract was concluded before July 1, 2021 and the obligations under it as of the date of the conclusion of the agreement on changing the terms of the contract were not fulfilled.
If the increase in the price of the contract is made within the limits of the cost of repair work established in accordance with the procedure for executing the federal budget for expenditures on road facilities and motor transport in the current year, it will not be required:
• amendments to the approved limits of budgetary obligations on expenditures on the road facilities and transport (repair work);
• conducting an audit of the investment program of repair work and projects of repair work for the effectiveness of the use of funds from the budgets of the budgetary system of the Russian Federation;
• additional control over the formation and use of budgetary allocations of road funds.
