The requirements for industrial products for the purpose of classifying them as products manufactured on the territory of the Russian Federation (appendix to the decree of the Government of the Russian Federation No. 719 of July 17, 2015) are supplemented by note 18, according to which the values of the number of points required for classifying passenger elevators (OKPD2 code 28.22.16.111) to products manufactured on the territory of the Russian Federation are established when purchasing under Federal laws of April 5, 2013. No. 44-FZ "On the contract system in the field of procurement of goods, works, services for state and municipal needs" and No. 223-FZ dated July 18, 2011 "On procurement of goods, works, services by Certain Types of Legal entities". So, the specified products will be equated to the Russian one if there are the following number of points:
The winner of the purchase did not sign the contract on time. The customer recognized him as evading. The data was included in the RNP.
The winner explained that he did not want to refuse the contract: on
the penultimate day for signing, the power supplies of the server equipment failed. This is confirmed by official memos of authorized persons and photos;
attempts have been made to fix the problem;
the customer was notified by letter about the breakdown, as well as about the winner's readiness to sign the contract at the first opportunity.
Since August 31, the "second extra"rule has been introduced for foreign radio-electronic products (REP) and some imported medical products with restricted access. The Ministry of Industry and Trade proposed to apply it in all cases without exceptions.
When purchasing such products within the national regime, it is impossible to use additional characteristics outside of the KTRU in the description of the object of purchase. This rule is not planned to be applied if, for example, there are no technical characteristics of the product in the catalog.
The participant must specify in the application:
• until December 31, 2022-information about the country of origin of the goods (for medical products from the EAEU). After this date — the entry numbers from the unified register of the Russian REP or the Eurasian register of industrial goods, as well as data on the total number of points, if this is provided for by Resolution No. 719 or Decision No. 105;
When evaluating applications, the customer deducted VAT from the price offers of participants who pay this tax. The Moscow UFAS considered this approach discriminatory. Participants in the USN were at a disadvantage and were forced to underestimate the price of the contract.
The Agency has prepared new additional requirements for procurement participants to replace the existing ones. The list of cases when they are needed will be expanded. A number of existing additional requirements will be adjusted.
Among other things, it will include (p. 12-13 of the annex to the draft resolution):
maintenance services for buildings and structures;
work on the current repair of buildings and structures.
A number of existing additional requirements will be adjusted. So, when purchasing works on capital repairs of a capital construction object (except for linear), participants will confirm their choice:
the presence of 5 years before the deadline for submitting applications of experience in the execution of the contract for work on the overhaul of the capital construction object (except for linear). It must be confirmed by a fulfilled contract under Law No. 44-FZ or a contract under Law No. 223-FZ, acts of work performed (p. 2 of the draft resolution, p. 9 of the annex to the draft resolution);
It is planned that when purchasing from small and medium-sized businesses, the customer will be able to provide a method of non-competitive procurement in the regulation. They will conduct it on the principle of an"electronic store". The changes may come into force on July 1, 2022.
They propose to fix the following features:
purchases should be carried out on an electronic platform;
the contract price cannot exceed 20 million rubles.;
List of industrial products originating from foreign countries (with the exception of the member States of the EAEU) in respect of which prohibits the admission for the purposes of procurement for state and municipal needs (Annex to decree of the Government of the Russian Federation of April 30, 2020 No. 616 (hereinafter – Decree No. 616), supplemented with new positions 25.1-25.7, including but not limited to, the following types of electronic products:
integrated circuits: electronic (code JECFA 2 26.11.30);
portable computers weighing no more than 10 kg, such as laptops, tablet computers, pocket computers, including those combining the functions of a mobile telephone, electronic notebooks and similar computer equipment (OKPD code 2 26.20.11);
The Government has supplemented the federal list of capital construction projects, for the purposes of architectural and construction design, construction, reconstruction, capital repairs, the features of procurement and contract execution provided for in Parts 56-63 of Article 112 of Federal Law No. 44-FZ of April 5, 2013 "On the contract system in the field of procurement of goods, works, services for state and municipal needs", approved by Order No. 2788-r of October 27, 2020. In accordance with these changes, since August 23 of this year, the corresponding list has been supplemented with objects of the Federal State Enterprise "Russian State Circus Company". At the same time, it is specified that the relevant purchases should be carried out by conducting a request for proposals in electronic form, indicating in the notification information about the enforcement of the contract (Decree of the Government of the Russian Federation No. 2313-r of August 23, 2021).
The rules of the national regime for public procurement of foreign medical products and radio-electronic products have been changed
We have published amendments to Resolution No. 925, which is responsible for the priority of Russian goods in competitive procurement. The changes will take effect on February 26, 2022.
