The rules for maintaining the register of contracts contain a list of information that is sent to be added to the register at the conclusion of the contract. The control bodies check it, in particular, for compliance with the terms of the contract.
The Treasury noted, among other things, that according to Law No. 44-FZ, part of the information for the register is optional in the contract, for example, the code of types of expenses. They are checked only if available. However, this code should be specified to monitor compliance with the amount of funding.
They also explained: if there is a requirement in the contract to ensure the performance of the contract (warranty obligations), and the winner from among the SMP and SONKO submitted supporting information instead, then data on the security is not entered into the register.
The rules of the register do not oblige to include information about the release of the counterparty from the number of SMP and SONKO from collateral. In this case, if there is no information about the security in the registry, this is not a reason for a negative result of the check.
