Explained the specifics of changing construction contracts under Law No. 44-FZ
In 2022, the construction contract can be changed if circumstances arise during its execution, due to which it cannot be executed. To do this, the government has established an order.
The Ministry of Finance noted: only state or municipal customers can adjust the contract according to this procedure.
Those who do not belong to them have the opportunity to change the contract for a special norm based on the decision of the relevant authority. So, based on the decision of the supreme executive body of the region, it is possible to adjust the contract for the needs of the subject. The Agency clarified: in such a decision, it is possible to provide conditions for its application similar to those that exist in the procedure for changing construction contracts due to unforeseen circumstances.
