In 2024, the maximum amount of advance payment for state contracts has been increased
Since January 25 of this year, the Government of the Russian Federation has reintroduced a measure similar to those in force in 2022-2023, which allows for the provision of an increased advance in government contracts concluded by recipients of federal budget funds. So, until December 31, 2024, inclusive, paragraph 4 of sub-item "a", as well as sub-item "b" (in terms of the right to provide advance payments, subject to treasury support in cases established in accordance with the budget legislation of the Russian Federation, in an amount not exceeding 30% of the amount of the contract). 18 of the Regulation approved by the Decree of the Government of the Russian Federation dated 09.12.2017 N 1496 has been suspended. At the same time, according to the "temporary" rule, if funds for financial support of a contract concluded in 2024 are subject to treasury support, advance payments are set at 30% to 50% of the contract amount, but no more than the limits of budget obligations. According to state contracts concluded in order to implement decisions on making investments in real estate in the territory of new subjects of the Russian Federation, advance payments can be increased up to 90%.
The Federal GRBS has been granted the right to adopt legal acts providing for the possibility of including conditions on treasury support in the state contract in order to increase the maximum amount of advance payment to 50% for contracts whose price is less than 100 million rubles.
Recipients of federal budget funds have the right, in accordance with Part 65.1 of Article 112 of Law No. 44-FZ, to amend contracts concluded before January 25 of this year in terms of establishing conditions for the payment of advance payments, including increasing the amount of advance payments, in compliance with the amount of contract enforcement established in accordance with Part 6 of Article 96 of Law No. 44-FZ.
The supreme executive bodies of state power of the subjects of the Russian Federation and local administrations are recommended to take measures to ensure that conditions on advance payments in appropriate amounts are included in concluded and previously concluded contracts.
