The Ministry of Construction of Russia clarified the procedure for changing the contract price in the construction sector
The order of the Ministry of Construction of Russia dated 17.01.2025 No. 18/pr was published on 18.04.2025, effective from 28.04.2025.
The Order establishes the possibility of changing the cost of contract work (including the cost of equipment) that is not related to preparatory work related to the construction and reconstruction of capital construction facilities, which are subject to the specifics of the implementation of projects (facilities) with a special status, similar to the procedure for changing the cost of preparatory work.
It should be recalled that by virtue of Part 56 of Article 112 of Law No. 44-FZ, until January 1, 2026, the subject of the contract may simultaneously be the preparation of project documentation and (or) the performance of engineering surveys, construction, reconstruction and (or) major repairs of a capital construction facility.
At the same time, according to Part 59 of Article 112 of Law No. 44-FZ, the procedure for determining the NMCC, the methodology for estimating such a contract, and the procedure for changing the contract price in the cases provided for in sub-paragraphs "a" of paragraphs 1 and 2 of Part 62 of Article 112 of Law No. 44-FZ are approved by the federal executive governmental body responsible for drafting and the implementation of state policy and legal regulation in the field of construction, architecture, urban planning.
