We inform you that from 04.04.2021 in the Unified Information System in the field of procurement (zakupki.gov.ru) (hereinafter referred to as the UIS), the system has been updated to version 11.1 in accordance with the changes in the procurement legislation. Information on updating the EIS is provided in the annex to the letter.
In addition, we inform you that in connection with the commissioning of the new version of the EIS on 23.03.2021, the Federal Treasury held an All – Russian meeting on the topic "New functionality of version 11.1 of the unified information system in the field of procurement" (hereinafter referred to as the webinar).
The bid of the auction participant with additional requirements was rejected. In support of the experience, among other things, he presented a copy of the executed contract without appendices-schedules for the execution and payment of work.
They plan to introduce requirements for a security guarantee in competitive procurement from SMSP under Law No. 223-FZ. So, the customer will accept guarantees of banks from the list under the Law N 44-FZ. Information about them must be in one of the registers under this law.
On April 24, the order of the Ministry of Digital Development, Communications and Mass Media of the Russian Federation on approval of standard terms of contracts for creation and (or) development (modernization) works comes into force.
The customer purchased works with project documentation. It contains a product of a specific manufacturer, but it is not possible to supply an equivalent.
The participant felt that the competition was limited. He could have supplied similar products. The purchase object is not unique. The purchased product does not belong to the exceptions when the equivalent can not be set.
The customer conducted one after another electronic auctions: for major repairs of the building and for construction control in relation to this object. Contracts based on the results of purchases were concluded with the same participant. However, the prosecutor's office challenged the contract for construction control services in court.
According to the Law N 223-FZ, the head of the customer, a member of the procurement commission will take measures to ensure that there is no conflict of interest in the purchase (p.1 of the project). The amendments were submitted to the State Duma.
The participant of the electronic auction submitted the minutes of the extraordinary meeting of participants on the approval of a major transaction as part of the second part of the application. The customer rejected the application due to the expiration of the decision to approve the transaction. In his opinion, the submission of the protocol meant that a decision was necessary to participate in the procurement.
The procurement regulations should include the procedure for determining and justifying the NMC, the price of the contract with a single supplier, and the price of a unit of labor.
The amendments on small e-procurement came into force in April. The price of one such purchase should not exceed 3 million rubles. inclusive. Customers can only purchase products.
