The agency told what to consider for customers and suppliers who want to write off the penalty under the contract.

In one day, the customer concluded 42 contracts for homogeneous work based on the results of small purchases from a single supplier.

The prosecutor considered that the single transaction was artificially fragmented in order to avoid competitive procedures. He demanded to invalidate the contracts and collect payment from the contractor.

The Ministry of Finance and the Ministry of Transport published a joint letter explaining the specifics of the purchase and the possibility of changing the essential terms of the regular transportation contract.

Also, these companies are allowed not to disclose /provide other information that is subject to disclosure and/or provision based on the requirements of the legislation of the Russian Federation.
