Economically significant business companies were allowed not to disclose information about their activities in the field of procurement
The President of the Russian Federation signed a Decree that allows business entities that are economically significant organizations in accordance with the Law of 08/04/2023 N 470-FZ not to disclose/not to provide information subject to disclosure/provision, including in accordance with federal laws N 44-FZ, N 135-FZ. Also, these companies are allowed not to disclose /provide other information that is subject to disclosure and/or provision based on the requirements of the legislation of the Russian Federation.
The right not to disclose information was granted by Decree to persons associated with such business entities (persons who are obliged or have the right to take direct ownership of shares/shares in the authorized capital of an economically significant organization, persons who have been transferred the right to take direct ownership of shares/shares in the authorized capital of an economically significant organization, economic communities that have been established in court and to whom the rights of a foreign holding company to shares/shares in the authorized capital of an economically significant organization have been transferred).
At the same time, the Decree provides that business companies that are economically significant organizations and related persons who have not disclosed/provided information are required to:
- send an appropriate notification to federal executive authorities and other persons who should receive such information;
- provide such information upon their requests. But the information provided in this case is not subject to disclosure, including posting in state information systems and other sources.
The decree came into force on January 27, 2024.
