Adjusted requirements for the formation of lots for the procurement of medical devices in accordance with Federal Law No. 44

The Government of the Russian Federation has supplemented the list of cases in which the requirement for the formation of lots provided for in paragraph 1 of the Decree of the Government of the Russian Federation of 04/19/2021 No. 620 "On the requirement for the formation of lots in the procurement of medical devices that are the object of procurement for state and municipal needs" (hereinafter - Resolution No. 620) is not applied. Thus, according to the new version of paragraph 2 of Resolution No. 620, this requirement does not apply, including in the procurement of medical devices, according to the results of which a contract with counter investment obligations is concluded in accordance with Article 111.4 of Federal Law No. 44.

These changes will come into force 7 days after the date of the official publication of the decree of the Government of the Russian Federation dated 12.09.2023 N 1479 and will not apply to relations related to the implementation of procurement, notices of which are posted in the Unified Information System in the field of procurement, invitations to participate in which are sent before the specified date, including to contracts, information about which is included in the register of contracts before the specified date.

Recall that according to paragraph 1 of Resolution No. 620, medical products of various types cannot be the subject of one contract (one lot), provided that the value of the initial (maximum) price of the lot exceeds 600 thousand rubles - for customers with less than 50 million rubles for their purchase in the previous year, 1 million rubles - for customers with a volume of funds from 50 to 100 million rubles and 1.5 million rubles - with a volume of funds of more than 100 million rubles.
