What will change in the legislation from July 1?

Important changes in procurement regulation are starting to take effect today, affecting customers and suppliers.:

- notification of the conclusion of a contract with a single supplier is now subject to sending by customers to the FAS of Russia only through the EIS within one business day. It must contain a justification for concluding a contract on the relevant grounds of Article 93 of Law No. 44-FZ (Article 1 of Federal Law No. 484-FZ dated December 26, 2024).;

- customers are required to digitally conclude a contract with a single supplier based on the results of a failed purchase when no applications have been received for the competitive procedure or all applications have been rejected (Part 4 of Article 8 of the Law of 07/02/2021 No. 360-FZ);

- for purchases of certain goods, under Law No. 223-FZ, the possibility of not applying the ban as a protective measure is abolished (subclause "k" of clause 10 of Decree of the Government of the Russian Federation dated December 23, 2024 No. 1875);

- it is allowed to specify payment details for third parties in the contract, in cases of payment of utility bills through agents, as well as payment to the owner when purchasing residential premises, when his representative participated in the conclusion of the contract (paragraph 11 of the Decree of the Government of the Russian Federation dated 01/27/2022 No. 60 as amended on 12/9/2024);

- the procedure for the formation of Information on the budget obligation is being changed, based on an extract from the draft state contract with a single supplier, information about which is to be included in the closed register of contracts, as well as the state contract, information about which is submitted by the customer for inclusion in the closed register of contracts. Such Information will be generated automatically by the Federal Treasury body (Clause 8 of the Procedure, approved by Order of the Ministry of Finance dated 10/30/2020 No. 258n, as amended on 11/25/2024);

- Today, the deadline for submitting reports on products actually delivered under the state defense order by organizations that are the only suppliers expires. Subsequently, such information must be submitted by them annually by July 1 (FAS Order No. 611/24 dated 09/06/2024).

A large number of updated GOST standards will also come into force, covering various sectors of the economy.
