On October 15, amendments to the procedure for determining the NMCC in urban planning will come into force. Among other things, we have expanded the list of customers who will use it. Clarified the rules for recalculating the estimated cost of construction, as well as the provisions on the preparation of the draft estimate.
The Ministry of Finance and the Ministry of Construction indicated: taking into account the amendments to the GRC of the Russian Federation, customers do not have the right to require participants to confirm membership in the SRO with documents when purchasing works:
on surveys and design;
construction, reconstruction, overhaul, demolition of capital construction facilities.
Since October 11, a number of regional and municipal customers can purchase goods, works, services, including for mobilization. The goods will not be subject to a ban on admission.
The winner did not sign the contract on time and did not provide collateral, because the manufacturer stopped deliveries due to the political and economic situation. The customer recognized him as evading. The information was included in the RNP.
In February, the parties terminated the contract for the repair and maintenance of highways. The situation was recognized as an emergency, because in winter without such works the roads could not be operated. While new auctions were being held, the customer concluded a deal with a single supplier.
On September 29, 2022, the State Procurement Committee of the Republic of Tatarstan jointly with the Procurement Development Center of the Republic of Tatarstan JSC held a seminar-meeting for republican customers on the topic: "Procurement in accordance with Federal Law No. 44-FZ of 05.04.2013 "On the contract system in the procurement of goods, works, services to ensure state and Municipal needs".
The customer purchased a surgical laser with special parameters. The participant complained that the requirements for the product limit competition. The inspectors found no violations.
Three instances supported their position:
The inspectors complained that the object of purchase was described for a specific manufacturer. A violation was found in the actions of the customer and ordered to eliminate it. The applicant decided to recover damages in the form of payment for the services of a representative in the antimonopoly authority.
The winner of the purchase of capital repairs did not sign the contract on time. The document was sent to the second participant, but he also refused to sign it due to changes in the economic situation. The controllers included the information in the RNP.
The Ministry of Industry and Trade proposed to supplement the list of foreign goods with a ban on admission.
