On March 31, 2022, a working meeting was held at the State Procurement Committee of the Republic of Tatarstan with Maxim Anatolyevich Topilin, Deputy of the State Duma of the Federal Assembly of the Russian Federation.
During the meeting, the key procurement indicators that were achieved in the Republic of Tatarstan by the end of 2021 were presented, as well as information on the prospects for the development of the procurement sector of the Republic of Tatarstan.
Information is provided on the activities of JSC "Procurement Development Center of the Republic of Tatarstan", the results of the work, including the ongoing work on the formation of a personnel reserve of specialists in the field of procurement.
The customer purchased works with project documentation. It indicated the goods of a specific manufacturer, but the ability to supply their equivalent was not established.
The inspectors considered this a violation: if there is, in particular, a specific manufacturer in the project documentation, then it is necessary to specify a condition in the purchase about the possibility of supplying an equivalent product.
The court supported this decision:
the absence of an equivalent condition violates the rules for describing the object of purchase. This may limit the number of participants who have the opportunity to supply similar products;
Suppliers of medicines and medical products can get into the register if the only manufacturer is from a country that has not imposed economic sanctions against the Russian Federation. Recall that it was recently allowed to purchase such goods from a supplier on a special basis.
To register, you need to contact the Ministry of Industry and Trade and provide a number of information, in particular:
a conclusion on the absence of analogues in the Russian Federation (the Ministry of Health — in relation to medicines, Roszdravnadzor — in relation to medical products);
accounting data for the last reporting period;
information of the organization that it is not undergoing liquidation or bankruptcy proceedings;
Since the beginning of the year, banks that have the right to issue independent guarantees have been required only to have a credit rating.
The government has fixed the indicators of such a rating as of February 1 of this year. They will not change until July 1.
The innovations came into force on March 25.
In 2022 and 2023, in order to determine the volume of purchases from SMP and SONKO, customers exclude contracts for the purchase of medicines and medical products from the state budget.
The government intends to reduce the payment period for state contracts to 7 working days after the signing of the acceptance certificate. The types of subjects that will be affected by the innovation are not directly named in the message.
As noted in the letter prepared by specialists of the Ministry of Finance of the Russian Federation, in accordance with Part 5 of Article 15 of Federal Law No. 44-FZ dated April 5, 2013 "On the contract system in the procurement of goods, works, services for State and municipal needs" when providing funds to a legal entity specified in paragraph 2 of paragraph 1 of Article 80 of the Budget Code, this person is subject to the provisions of Law No. 44-FZ regulating the activities of the customer, in cases and within the limits defined in the framework of agreements on the participation of the Russian Federation, the subject of the Russian Federation or the municipality in the ownership of the subject of investment.
The State Duma adopted in the third reading amendments to Law No. 44-FZ aimed at simplifying procurement under sanctions. In 2022 and 2023, in order to determine the volume of purchases from SMP and SONKO, customers will exclude contracts for the purchase of medicines and medical products from the state Budget (Article 3 of the bill).
The changes relate to the procurement of federal and regional authorities, their subordinate institutions and enterprises, as well as municipal medical organizations.
Amendments have been made to paragraph 8 of the Decree of the Government of the Russian Federation No. 19 of January 13, 2014.
Currently, in accordance with it, when concluding a contract, the price formula and the maximum value of the contract price are indicated in the case of concluding a contract for a period of at least 3 years, including a life cycle contract, the subject of which is the supply, maintenance and (or) repair of certain types of transport, if the NMCC is 1 billion rubles and more (Decree of the Government of the Russian Federation No. 350 dated March 12, 2022).
Since March 22, this rule also applies to the supply under the lease agreement.
The customer has provided in the documentation the possibility to allow for the purchase of applications that do not meet its conditions for the composition of documents, if the absence or inconsistency of the latter
does not affect the content and conditions of the application, as well as the execution of the contract;
does not entail the risk of default.
