The state contract was not signed due to a sharp increase in prices - the court found no grounds for the RNP
The winner of the purchase of capital repairs did not sign the contract on time. The document was sent to the second participant, but he also refused to sign it due to changes in the economic situation. The controllers included the information in the RNP.
The court did not agree with them:
the controllers did not find out why the participant refused to sign the contract;
foreign trade restrictions have led to a sharp rise in prices. The cost of the work exceeded the offer price by 2 times. That this could have been foreseen has not been proven;
before the end of the contract signing period, the participant notified the customer that he could not conclude a deal because the economic situation in the country had changed.
When considering the case, the court also took into account that the participant has a long-standing reputation as a conscientious supplier, and previously he was not included in the RNP.
