According to experts of the Ministry of Finance of the Russian Federation, Federal Law No. 223 does not contain provisions on the possibility of participating in a competitive procurement involving small and medium-sized businesses of several legal entities or several Individual Entrepreneurs acting on the side of one participant in the procurement.

The form of the conclusion of the state customer on the price per unit of products supplied under the state defense order has been approved when forming the price of a state contract concluded with a single supplier, as well as when transferring other types of product prices to a fixed price.

The supplier was required to pay penalties for late fulfillment of obligations. He partially repaid them, because when calculating, he applied the key rate on the delivery date, and not the one that was valid on the day of payment of the penalty. The customer appealed to the court.

The draft of the relevant decree of the Government of the Russian Federation in order to fulfill the requirement provided for in subparagraph "l" of paragraph 4 of the Procedure for preparing draft legal acts and instructions of the President of the Russian Federation, draft legal acts of the Government of the Russian Federation approved by Decree of the President of the Russian Federation dated 14.09.2020 N 558, was prepared by specialists of the Ministry of Health of the Russian Federation. According to experts of the ministry, the customer, when describing the object of purchase, independently determines the share of secondary raw materials used in the production of goods for which, in accordance with the decree of the Government of the Russian Federation of 08.07.2022 N 1224, environmental requirements are established.

The Ministry of Industry and Trade of the Russian Federation, in accordance with paragraph 1 of the Decree of the Government of the Russian Federation dated 23.01.2021 N 34, approved the Procedure for determining the initial maximum contract price, the price of the contract concluded with a single counterparty, and the initial unit price of goods when purchasing shipbuilding industry products (with the exception of products purchased under the state defense order)

The inspectors complained that the participants in the procurement of design works were required to be members of a Self-regulatory organization not only in the field of architectural and construction design, but also in the field of engineering surveys. This limited the competition.
