Changed the rules of procurement from the supplier on the grounds of
Resolution No. 339 was brought into line with the changes that extended anti-crisis measures for 2024.
The reservation was excluded from Resolution No. 339 that additional grounds are used for purchases from a single supplier in accordance with part 1 of Article 15 of Law No. 46-FZ. Thus, the order was brought into line with the changes that the legislators made to 44-FZ and 46-FZ. We talked about these changes in a separate news item.
The very order in which contracts are concluded on additional grounds from Resolution No. 339 has not changed. It is possible to purchase TRU only from food suppliers, whom the Government or the supreme executive body of the subject has identified in the acts. At the same time, at the moment only the supreme executive body of Moscow can independently establish additional grounds for purchasing from a single supplier (clause 2.3 of Article 15 of Law No. 46-FZ). Contracts with such suppliers can be concluded no later than December 31, 2024.
Additionally, we remind you that customers should not abuse purchases from a single supplier on additional grounds, so as not to limit competition and comply with the rules of the national regime. Such explanations were given by the Ministry of Industry and Trade in a letter dated 04/27/2022 No. OV-39122/12.
