The government has corrected some acts on public procurement and procurement under Law No. 223-FZ. The changes relate, among other things, to the rules for forming a purchase plan and schedule, the register of contracts and the register of contracts, and the report on purchases from SMPS. Let's talk about the main innovations.
The customer refused to perform the contract with the company and applied to the Antimonopoly authority to include information about it in the RNP.
The proceedings were suspended several times: first, the supervisors waited for the court's decision on the legality of the unilateral termination of the contract to come into force, and then — when they would consider the company's appeal against this decision. Therefore, the information in the RNP was included only after 2 years.
The Cabinet of Ministers approved amendments to several documents used by state customers under Law No. 223-FZ.
A Bank guarantee can provide, in particular, obligations under a contract. In some cases, the customer must refuse it. If such a decision is made, it is necessary to notify the supplier (contractor, contractor), specifying the reasons for the refusal.
The Ministry of Finance explained that the notification is prepared in free written or electronic form. It is enough to list the reasons for refusing to accept a Bank guarantee. There are no other requirements for the document.
Starting from October 22, the rules for reviewing customer requests to determine a supplier for purchases under clause 2, part 1, article 93 of Law No. 44-FZ apply. They contain a list of information to include in the appeal. The Ministry of Finance explained exactly how to reflect the information in it.
The Treasury has released a review of fiscal irregularities for the first half of 2020. These include errors in public procurement. Customers made a significant part of them when calculating the NMC and executing the contract. Let's focus on the main ones.
A participant in a construction purchase with additional requirements complained that his application was unreasonably rejected. He provided all the necessary documents and information to confirm the experience.
The customer explained that he was acting legally: the application was terminated by agreement of the parties to the contract. This document does not confirm the experience.

The Ministry of Finance wants to clarify the procedure for generating information for the register of contracts. In particular, customers will send information on contracts with the self-employed (paragraph 2 of paragraph 1 of the amendments).
The rules for specifying information about the country of origin of goods will also be adjusted. So, if the contract for the performance of works (services) provides for the delivery of goods, then it must reflect the country of origin (paragraph 2 of paragraph 4 of paragraph 2 of the amendments).
