Ministry of Economic Development approved the order from 31.03.2015 № 189 "About approval of the use of closed negotiation methods of determining the suppliers (contractors, performers) and the procedure for the agreement to enter into a contract with a single supplier (contractor, executor)."

Customers in the contract should be determined the norm, according to which the payment will be forfeit. This is due to the following. The federal law from 05.04.2013 N 44-FL does not establish the obligation of the customer at the contract conclusion indicated in it the formula for calculating the penalty. However, the contract must include a mandatory condition of the responsibility of the parties for non-performance or improper performance of obligations provided for.

One of the participants presented as part of the application a copy of a license issued by a third party, as well as a contract in which the person agrees to act as a subcontractor of the participant. Customer are rejected the request. The competition authority admitted his actions in violation of the Federal Law of 05.04.2013 N 44-FL, the customer with the decision disagreed and appealed to the court.
