The Government of the Russian Federation has approved a draft agreement with the Government of the Republic of Belarus on mutual recognition of bank guarantees in the implementation of state (municipal) procurement.

The customer applied restrictions on the admission of foreign medicines from vital and essential medicines and rejected the application with Indian goods. The reason is the inconsistency of information and documents with the notification.

Representatives of the Ministry in their letter noted that customers, considering the issue of establishing additional requirements for participants in accordance with the decree of the Government of the Russian Federation dated 29.12.2021 N 2571, should proceed from the formed object of purchase, including taking into account the types of work, services, type of object, as well as the initial (maximum) contract prices.

According to the experts of the Ministry of Finance of the Russian Federation, the customers specified in Part 8.1 of Article 3 of Federal Law No. 223, the provisions of Article 23 of Federal Law No. 44 and the Decree of the Government of the Russian Federation dated 08.02.2017 No. 145 "On approval of the Rules for the formation and maintenance in the unified information system in the field of procurement of a catalog of goods, works, services to ensure state and Municipal the requirements and Rules for the use of the catalog of goods, works, services for state and municipal needs" are not guided. Accordingly, these customers have no obligation to use the catalog of goods, works, services to meet state and municipal needs in order to describe the object of purchase.

According to experts of the Ministry of Finance of the Russian Federation, Federal Law No. 223 does not contain provisions on the possibility of participating in a competitive procurement involving small and medium-sized businesses of several legal entities or several Individual Entrepreneurs acting on the side of one participant in the procurement.

The form of the conclusion of the state customer on the price per unit of products supplied under the state defense order has been approved when forming the price of a state contract concluded with a single supplier, as well as when transferring other types of product prices to a fixed price.

The Government of the Russian Federation, in accordance with Part 18 of Article 44 of Federal Law No. 44, has established the following features of providing security for applications in the form of funds by persons registered in the territory of the member states of the Eurasian Economic Union, or who are citizens of these countries:

These standard conditions were approved by the Government of the Russian Federation in accordance with part 11 of Article 34 of the Federal Law No. 44.

The supplier was required to pay penalties for late fulfillment of obligations. He partially repaid them, because when calculating, he applied the key rate on the delivery date, and not the one that was valid on the day of payment of the penalty. The customer appealed to the court.

In a letter prepared by specialists of the Treasury of Russia, in particular, it is explained that if the customer has not posted a procurement regulation or if a negative conclusion has been issued in relation to the annual procurement report from small and medium-sized businesses, the sign of an unplaced procurement regulation is automatically established in the unified procurement information system.
