Cession for government (municipal) contracts: enabled or disabled

Russia's Finance Ministry opinion is the assignment of rights to state and municipal contracts supplier (contractor, executor) to a third party is not allowed.

This position is based on the following departments:

- Legal relations arising from the conclusion of these contracts are governed by including the budget legislation, which does not provide the ability to change the previously provided data on contractors to carry out the authorization of expenditure for the new recipient;

- In some cases the identity of the creditor is essential to the debtor. In particular, it is important, if the supplier is determined to a limited number of participants purchases in accordance with Art. 27 - 29 of the Federal Law of 05.04.2013 N 44-FL.

In addition, the possibility of the cession of contracts would create certain risks for the budget system.
