The FAS explained that if the customer prescribes a specific sterilization method in the documentation (for example, with ethylene oxide only), this violates the law and restricts competition.
The agency's position is based on Roszdravnadzor's explanations. According to them, medical products that have passed state registration are recognized as safe for use regardless of the method of sterilization, if it meets established standards.
The FAS noted that the territorial authorities did not always take this approach into account. In order to form a uniform law enforcement practice, the service has sent relevant clarifications that must be taken into account when conducting control measures.
