How should customers choose the method of calculating the NMCC for landscaping?
The Ministry of Finance of the Russian Federation has considered the possibility of using the design and estimate method (including within the framework of the order of the Ministry of Construction of the Russian Federation No. 841/pr) in determining the initial (maximum) contract price for landscaping.
According to Part 6 of Article 22 of Law No. 44-FZ, the NMCC is determined using one or more methods. At the same time, the method of comparable market prices (market analysis) is a priority. The use of other methods is permitted only in cases expressly provided for by law.
The design and estimate method is allowed for:
– construction, reconstruction, overhaul, demolition of capital construction facilities (subject to the availability of project documentation)
– works on the preservation of cultural heritage sites
– routine repairs of buildings, structures, facilities, premises (part 9.1 of art. 22)
If it is impossible to apply these methods, the customer has the right to use other calculation methods, but is obliged to include in the justification of the NMCC an explanation of the reasons why the basic methods cannot be applied (Part 12 of art. 22).
