The Ministry of Finance clarified the rules for describing the object of purchase, the register of unscrupulous suppliers and the procedure for small purchases.
The Agency noted that for purchases from a single supplier, notification of such a purchase is not required (part 3 of art. 93 44-FZ), therefore, the rules for describing the object of purchase do not apply (art. 33 44-FZ).
A procurement participant may be deemed to have evaded the conclusion of a contract only based on the results of competitive procedures and procurement under Part 12 of Article 93 (failed procedure). At the same time, the register of unscrupulous suppliers according to 44-FZ includes information about evaders and those who have not fulfilled the contract.
It is additionally clarified that the procedure for conducting small purchases through regional electronic stores and quotation sessions is currently regulated by the regulations of the information systems themselves. There is no direct reference in Law No. 44-FZ to such a mechanism.
