Is it possible to conclude a contract with a monopolist without an EIS?
In a letter dated 01/21/2026, the Ministry of Finance of the Russian Federation considered the issue of concluding a contract with a single supplier under clause 1, Part 1, Article 93 of Law No. 44-FZ. The Agency confirmed that the use of the EIS in this case is the right, not the obligation of the customer.
If the customer decides to exercise this right, he can form a draft contract without using the EIS. The exception is the calculation of the price and the purchase identification code (PID): they must be specified in the system.
The Law also establishes cases when the conclusion of a contract is possible only through the EIS (for example, paragraph 2, 6, 6.1, 11, 12, 54, 55 part 1 of Article 93). When such a contract is included in the register and executed, the same rules apply as for contracts concluded following electronic procedures.
