The Ministry of Finance of the Russian Federation has issued clarifications on the application of sub-paragraphs "h" and "o" of paragraph 1 of Part 1 of Article 43 of Federal Law No. 44-FZ, which regulate the procedure for confirming the compliance of procurement participants with uniform requirements.
The Agency clarified that the concept of "state register" is not limited to the list approved by the Decree of the Government of the Russian Federation dated 04/25/2006 No. 584-R. State registers also include:
– registers of members of self-regulatory organizations (SRO);
– registers of licenses for certain types of activities provided for by Federal Law No. 99-FZ "On Licensing of Certain Types of Activities".
Thus, if information about the participant's compliance with the established requirements is contained in open and publicly available registers, the participant has the right not to attach additional supporting documents, but to limit himself to a declaration indicating the relevant register.
