The Ministry of Finance clarified some issues of the application of the features of the definition of NMCC in accordance with the Decree of the Government of the Russian Federation No. 1875

The Ministry of Finance of the Russian Federation clarified the rules for determining the initial (maximum) contract price, the application of price restrictions and the procedure for interaction with the state information system of industry. The main issues: 1. The possibility of using different sources of price information when determining the initial (maximum) contract price (NMCC), if the data differ from those established by the methodology of Resolution No. 1875. 2. The applicability of the features of the definition of the NMCC for the purchase of goods from Appendix No. 2 to Resolution No. 1875 at a unit price above 5 thousand rubles. 3. Application of the specifics of the definition of NMCC when purchasing from a single supplier in accordance with paragraphs 4 and 5 of part 1 of Article 93 of Law No. 44-FZ. 4. The need to clarify in which GIS registries information about manufacturers should be sought in order to send a request for the price of goods. 5. Interpretation of the term "such prices" in the context of subparagraph "i" of paragraph 5 of Resolution No. 1875 concerning the limitation of the unit price of 300 thousand rubles. The essence of the Ministry of Finance's response 1. The Ministry of Finance indicated that the position on the application of the specifics of the definition of NMCC is set out in paragraph 11 of the letter of the Ministry of Finance dated January 31, 2025 No. 24-01-06/8697. 2. The customer determines and justifies prices in accordance with the provisions of Article 22 of Law No. 44-FZ, taking into account the established specifics of price determination. 3. The specifics of price determination do not regulate the issues of calculating price values by the customer, and such issues are resolved in a general manner. 4. The specifics of determining prices apply to the goods specified in Appendices No. 1 and No. 2 to Resolution No. 1875, regardless of the method of determining the supplier (contractor, contractor). 5. The provisions of subparagraph "i" of paragraph 5 of Resolution No. 1875 relate to the unit price used to determine the initial (maximum) contract price, but do not impose requirements on the prices used to calculate this unit. 6. For questions concerning the state information system of industry (GISP), it is proposed to contact the Ministry of Industry and Trade of the Russian Federation.
