Responsibility measures in the field of procurement have been changed

Since March 1, 2025, comprehensive amendments have been introduced to the Code of Administrative Offences of the Russian Federation for violations of procurement rules in accordance with 44-FZ.

The regulations provide for the modification of fines for officials and legal entities for various types of violations, as well as the introduction of warnings for certain offenses.

A warning may be issued for violating the procedure for forming, approving, and changing procurement schedules or terminating a contract with a unilateral refusal. At the same time, the size of sanctions for officials will change.:

- for choosing the wrong purchase method - from 30,000 to 50,000 rubles;

- for non-compliance with the established volume of purchases from SMP and SONKO - from 40,000 to 60,000 rubles;

- for violations of the term of the contract - from 5,000 to 30,000 rubles.

Mitigating and aggravating circumstances, as well as the degree of the customer's guilt, will be taken into account when determining the amount of the fine.

The new type of fine under Law No. 44-FZ concerns an official who failed to apply liability measures to a supplier (contractor, contractor) who violated a contract. For such an offense, he will be fined from 10 thousand to 20 thousand rubles.

For customers working under Law No. 223-FZ, the new fines apply to those who failed to comply with the mandatory volume of purchases from SMEs. For officials for this offense, they will amount from 30,000 to 50,000 rubles, and for legal entities – from 50,000 to 100,000 rubles.
