The Government of the Russian Federation, in accordance with Article 14 of Law No. 275-FZ, obliged the head executors and executors of the supply of products under the state defense order, military missions to submit to the antimonopoly authority information on all facts of price increases for raw materials, materials and components, works, services necessary to fulfill the state defense order, if the established or proposed price is more than It exceeds by 5% the price calculated using price indices and deflator indices for types of economic activity determined by the Ministry of Economic Development of the Russian Federation.
The specified information is not submitted to the antimonopoly authority if:
- the established or proposed price is formed based on the results of competitive procedures conducted in accordance with Law No. 44-FZ;
- the established or proposed price does not exceed the level of the price prevailing on the stock exchange or determined in accordance with official statistical information;
- the established or proposed price for raw materials, materials and components, works, services supplied to the head contractor does not entail the risk of an increase in the price of the final product;
- the price is formed by a natural monopoly entity and does not exceed the price (tariff) and (or) their maximum level determined for it;
- the total cost of each nomenclature item of raw materials, materials and components, works, services purchased under one contract is less than 1 million rubles;
- the established or proposed price is formed by a microenterprise.
The Government Decree came into force on September 1, 2024.
