The Agency considered the impact of the OKPD2 code in the evaluation of applications and the application of the national regime under Resolution No. 1875. The Ministry of Finance made two key clarifications.
First, the OKPD2 code in the product catalog (KTRU) is for reference purposes and does not relate to the description of the object of purchase under art. 33 of Law No. 44-FZ. Therefore, the difference between the code in the notification and the code indicated by the participant in the application is not a reason for rejecting the application or for refusing to conclude a contract.
Secondly, when confirming the Russian origin of the goods in accordance with Resolution No. 1875, the participant must submit a registry entry with localization points (if the points are set by Resolution No. 719).
Thus, customers should not reject applications due to a mismatch between the OKPD2 codes, and suppliers should check for points in the registry entry.
