Russian President Vladimir Putin has signed a law on optimizing the public procurement procedure, which will establish a unified procedure for granting advantages to domestic goods. The relevant document is posted on the portal of the official publication of legal acts.
The law was developed to further simplify the processes and procedures for the procurement of domestic products in accordance with the laws on the contract system in the field of public procurement (44-FZ) and on the procurement of goods (works, services) by state corporations, state-owned companies and natural monopolies (223-FZ).
The Law establishes the legal grounds for a complete ban or restrictions on the participation in auctions of certain foreign goods (works, services). In particular, it provides for a transition from the "third superfluous" principle to a more stringent "second superfluous" one (when foreign bids are withdrawn from the auction if there is at least one Russian one). It is expected that this will strengthen incentives for investment and increase production of Russian products.
Another preference will be the application of a coefficient to all Russian goods, which improves the price offer of domestic companies by 15%.
In the case of competition between several domestic products, preference will be given to a product with a higher technological level of localization of production, Russian Prime Minister Mikhail Mishustin explained earlier.
According to him, the rules for competitive procurement and the selection of the winner should become as simple and understandable as possible for all parties and be based on the unconditional priority of Russian brands. This will stimulate the creation of new own production facilities, including in radio electronics, metallurgy, railway and agricultural machinery, automotive industry, machine tool industry, textile, furniture, pharmaceutical industry and other important areas for the country.
The law, which contains other provisions, will enter into force on October 1, 2024, with the exception of certain norms for which a different deadline has been set. At the same time, most of the changes will begin to apply to relations that have arisen since January 1, 2025.
