Law No. 44-FL has been amended

In accordance with Federal Law No. 124-FL signed by the President of the Russian Federation dated 29.05.2024, a number of provisions of Law No. 44-FL have been adjusted. In particular, the new version sets out the definition of the concept of "customer" provided for in paragraph 7 of Part 1 of Article 3 of Law No. 44-FL, which now includes, among other things, the legal entities specified in Part 4, Part 4.3 and Part 4.4 of Article 15 of Law No. 44-FL. At the same time, Article 15 of Law No. 44-FL has been supplemented with a new part 4.4, which imposes on joint-stock companies, 100% of whose shares belong to the subject of the Russian Federation, the obligation to comply with the provisions of Law No. 44-FL when making purchases in order to fulfill obligations under contracts concluded with them on the basis of paragraph 6.1 of Part 1 of Article 93 of Law No. 44-Federal Law. Part 4 of Article 15 of Law No. 44-FL is also set out in a new version, providing for the need to comply with the provisions of Law No. 44-FL in some cases not only by autonomous institutions, but also by other legal entities. And Part 4.1 and Part 5 of Article 15 of Law No. 44-FL have been declared invalid.

In addition, the list of procurement cases provided for in paragraph 5 of Part 11 of Article 24 of Law No. 44-FL has been supplemented. In particular, closed competitive methods are used, including in the case of procurement:

- at the expense of funds provided from the federal budget within the framework of agreements on the provision of subsidies or budget investments containing a condition for the use of closed competitive methods;

- at the expense of budgetary funds provided within the framework of agreements on the provision of subsidies or budget investments concluded with customers from among law enforcement agencies or customers subject to international sanctions;

- carried out by budgetary institutions, autonomous institutions, unitary enterprises or other legal entities on behalf of the above-mentioned customers.

These changes will take effect on January 1, 2025. In addition, it is determined that legal entities that have been provided with subsidies provided for in subparagraph 2.1 of paragraph 1 of Article 78.3 of the Budget Code of the Russian Federation will purchase from the funds of these subsidies in 2024 in accordance with Part 4.1 of Article 15 of Law No. 44-FL. This provision applies from June 9, 2024.
