The Federal Antimonopoly Service explained the procedure for confirmation by procurement participants under Law No. 44-FL of compliance with the requirements established in accordance with the legislation
Experts of the antimonopoly department note that since the confirmation of compliance of the procurement participant with the requirements set out in paragraph 1, part 1, Article 31 of Law No. 44-FL is the presence of an appropriate entry in the register of licenses, the establishment by the customer of a requirement for the procurement participant to confirm the availability of a license solely by providing an extract from the register of licenses as part of the application may contain signs of violation of legislation about the contract system.
Earlier, representatives of the Federal Antimonopoly Service of Russia explained that the participant provides as part of the application a document containing information that provides the possibility of confirming that he has a special permit for the right to carry out a specific type of activity (license), including its status (valid, not suspended, not partially suspended, not terminated). In this case, confirmation of the participant's compliance with the requirements will be the presence of an appropriate entry in the license register, which the customer is obliged to verify by virtue of Part 8 of art. 31 of Law No. 44-FL.
