The list of grounds for which customers of the subjects of the Russian Federation have the right to make purchases under Law No. 44-FZ from a single counterparty has been adjusted
The list of cases in which the issuance of acts of the Supreme executive body is allowed has been supplemented by paragraph 2 of the Decree of the Government of the Russian Federation dated 03/10/2022 No. 339 "On cases of procurement of goods, works, services for State and (or) municipal needs from a single supplier (contractor, contractor) and the procedure for their implementation" (hereinafter - Resolution No. 339). the subject of the Russian Federation and municipal legal acts, on the basis of which customers have the right to make purchases from a single counterparty, not provided for in Part 1 of Article 93 of Law No. 44-FZ. Thus, the number of cases of non-competitive purchases includes purchases of goods, works and services carried out by:
- for the implementation of measures and measures provided for by Decree of the President of the Russian Federation No. 757 dated 10/19/2022 "On Measures implemented in the Subjects of the Russian Federation in connection with Decree of the President of the Russian Federation No. 756 dated October 19, 2022" (hereinafter - Decree No. 757);
- to ensure economic, social and legal guarantees for the protection of the rights and legitimate interests of individuals in accordance with the Federal Law "On Refugees" and the Law of the Russian Federation "On Internally Displaced Persons";
- for individuals (including the purchase, rental of real estate) who have suffered and (or) residential premises, other property of which has been lost or damaged as a result of hostilities, acts of aggression against the Russian Federation, for individuals who have forcibly left the territories of the Russian Federation, where martial law has been imposed, the territories of the subjects of the Russian Federation The Federations specified in paragraph 3 of Decree No. 757;
- in accordance with the decree of the Government of the Russian Federation dated 03.10.2022 No. 1745 "On a special measure in the field of economics and amendments to the Decree of the Government of the Russian Federation dated April 30, 2020 No. 616";
- to carry out civil defense activities;
- to restore facilities damaged (destroyed) as a result of hostilities, acts of aggression against the Russian Federation.
In addition, the provisions of Resolution No. 339 are extended to procurement cases in accordance with Part 4, Part 4.1, Part 4.3 and Part 5 of Article 15 of Law No. 44-FZ.
These changes came into force on April 1 of this year.
